Yeah but the Seigel's may not have the right to sell Superman. They only got a partial interest in the Superman copyright and DC is arguing that DC owns the Superman trademarks meaning his shield, blue tights with red underwear, Smallville, flying, etc... basically all of the things that either weren't in the early Seigel stories or were changed significantly from those original stories.

On top of that, DC is also arguing that the Seigel's only own an interest in Earth-1 Superman and that the present day Superman has been so changed so much through retcons that he is a separate entity entirely. The law isn't settled on these questions so DC could tie a sale up in litigation for years in Supreme Court, then 3 layers of appeals court in NY, then maybe even the Supreme Court if they would take it. Sure Marvel's got money behind it but DC's backed by Time-Warner who I'm sure would spend a ton to keep the Superman franchise. It just doesn't seem worth it for Marvel to spend that kind of money, particularly when they are already dominating the comics industry without Supes.

I don't remember that specifically, but they claimed copyright ownership over the Siegel/Schuster stuff which first mentioned Krypton. That sounds like part of the whole argument; which parts of Superman resulted from the original work product and which parts were created or changed so that they were solely DC property. If the family was right then they could have possibly prevented DC from using the name Krypton or at the very least, make that threat to try and squeeze DC.
